Announcement for Shareholders – 17 August 2017
In accordance with the regulations of the Ljubljana Stock Exchange and applicable legislation, Datalab Tehnologije, d. d., is publishing the following message:
Datalab Tehnologije d. d. was sued by RR & CO. Raziskave, razvoj in prenos znanja, d. o. o., for EUR 238,417.69 with default interest.
On 16 June 2016, the District Court in Ljubljana issued judgment VI Pg 134/2014, wherein the claim for the payment of EUR 183,122.81 with legal default interest from 3 October 2013 until payment and EUR 49,116.80 with legal default interest from 3 October 2013 until payment was dismissed as unfounded.
It decided that the defendant must pay the plaintiff only EUR 4,178.08 with legal default interest from 2 October 2013 until payment and the procedural costs in the amount of EUR 44.00 with legal default interest which starts accruing the day after the 8-day period after the enforcement order was served until payment (which the defendant did).
The plaintiff lodged a complaint with the Appellate court. With the ruling No. I Cpg 1083/2016 from 7 June 2017, the Appellate court upheld the plaintiff’s claim and decided that the defendant still owes:
– EUR 49,116.80 with legal default interest from 10 October 2013 until payment
– EUR 183,122.80 with legal default interest from 10 October 2013 until payment
– Procedural costs amounting to EUR 7,447.43 with legal default interest starting to accrue on the day after the 15-day payment deadline
– Costs of appeal amounting to EUR 6,522.12 with legal default interest starting to accrue after the deadline set by the court and until payment.
Datalab Tehnologije d. d. will appeal on all points of law at the Supreme Court of the Republic of Slovenia, because the decision of the Appellate court in Ljubljana is deemed incorrect and illegal, and use all legal means to protect its interest in case of enforcement and to achieve a stay of enforcement.
This notice will be publicly available at the company’s website (www.datalab.eu) from 17 August 2017 for at least five years.
